Welcome to Semiotic, a mobile app owned and operated by EGODEATH LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Semiotic app, features, content, and services ("the Service"). By using Semiotic, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Eligibility and Geographic Restrictions

• You must be at least 18 years old to use Semiotic
• You must have the legal capacity to enter into binding agreements
• The Service is currently available only to users located in the United States and Canada
• By using the app, you represent and warrant that you meet these requirements

2. Your Account and Security

Your Responsibilities:

• Maintain the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Provide accurate and complete information when creating your account
• Notify us immediately if you suspect unauthorized access to your account

Account Termination:

• You may delete your account at any time through the app or by contacting support@semiotic-app.com
• Account deletion will permanently remove your data according to our Privacy Policy
• Some information may be retained as required by law or for legitimate business purposes

3. Acceptable Use Policy

You agree to use Semiotic only for lawful, personal, and non-commercial purposes.

Prohibited Activities:

• Harassing, abusing, threatening, or harming others
• Uploading illegal, obscene, defamatory, or harmful content
• Impersonating others or providing false information
• Attempting to reverse engineer, hack, or tamper with the app
• Interfering with the Service's functionality, security, or availability
• Using automated tools (bots, scrapers) without permission
• Attempting to gain unauthorized access to other users' accounts
• Sharing your account credentials with others
• Using the Service for commercial purposes without our consent

Enforcement:

We reserve the right to investigate violations and take appropriate action, including:

• Warning users about policy violations
• Temporarily suspending accounts
• Permanently terminating accounts
• Reporting illegal activities to law enforcement
• Seeking legal remedies for damages

4. Intellectual Property Rights

Our Property:

• All content, branding, designs, text, graphics, software, and features within Semiotic are owned by EGODEATH LLC or our licensors
• Protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, or create derivative works without written consent

Your Content:

You retain ownership of your original dream entries and journal content.

By using the Service, you grant us a limited, non-exclusive, revocable license to:

• Store and process your content to provide app features
• Use anonymized, aggregated data for service improvements
• Display your content back to you across devices

This license terminates when you delete your content or account.

User-Generated Content:

• If you share dreams publicly within the app, you grant other users permission to view that content
• You are solely responsible for content you choose to share
• We may remove content that violates these Terms

5. AI Services and Interpretive Content

Nature of AI Analysis:

• Semiotic uses AI-powered tools, including third-party services (such as Anthropic), to provide dream analysis
• AI interpretations are generated by algorithms and are not human professional opinions

Important Disclaimers:

• Not Professional Advice: AI interpretations are for informational and self-reflective purposes only
• Not Medical/Psychological Treatment: The Service is not a substitute for professional medical, psychological, therapeutic, or psychiatric care
• No Guarantees: We make no warranties about the accuracy, reliability, completeness, or effectiveness of any AI-generated content
• User Responsibility: You are solely responsible for how you interpret and act upon AI-generated content
• Seek Professional Help: If you are experiencing mental health concerns, psychological distress, or other serious issues, please consult qualified healthcare professionals

6. Subscriptions and Payments

Billing Terms:

• Some features require paid subscriptions or credits
• Pricing and payment terms are displayed within the app
• Billing is handled through your device's app store (Apple App Store, Google Play Store)
• You are responsible for all charges incurred under your account

Subscription Management:

• Subscriptions automatically renew unless cancelled
• You can manage or cancel subscriptions through your app store account settings
• Cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial subscription periods

Changes to Pricing:

• We may change subscription prices with 30 days' notice
• Price changes will not affect your current billing cycle
• Continued use after price changes constitutes acceptance

7. Service Availability and Modifications

Service Availability:

• We strive to maintain continuous service availability
• The Service may be temporarily unavailable due to maintenance, updates, or technical issues
• We do not guarantee uninterrupted access

Service Modifications:

• We may modify, update, or discontinue features at any time
• We will provide reasonable notice for significant changes when possible
• Some changes may be necessary for security, legal compliance, or technical reasons

"AS IS" SERVICE: Semiotic is provided "as is" and "as available" without any warranties of any kind.

Disclaimed Warranties:

To the fullest extent permitted by law, we disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission or storage

Third-Party Services: We are not responsible for the performance, availability, or content of third-party services integrated with Semiotic.

11. Limitation of Liability

Scope of Limitation:

To the maximum extent permitted by law, EGODEATH LLC and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage (except where prohibited by law)
• Damages arising from third-party services or content

Maximum Liability:

Our total liability for any claim shall not exceed the greater of:

• $100 USD, or
• The amount you paid for the Service in the 12 months prior to the claim

State Law Variations: Some states do not allow limitations on certain damages, so these limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless EGODEATH LLC from any claims, damages, or expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or share through the Service

13. Dispute Resolution

Governing Law: These Terms are governed by Oregon state law, without regard to conflict of law principles.

Informal Resolution: Before filing any legal action, you agree to contact us at support@semiotic-app.com to attempt to resolve the dispute informally.

Jurisdiction: Any legal disputes will be resolved in the state or federal courts located in Portland, Oregon.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete agreement between you and EGODEATH LLC
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect
• No Waiver: Our failure to enforce any provision does not waive our right to enforce it later
• Assignment: We may assign these Terms to affiliates or in connection with a merger or sale. You may not assign your rights under these Terms

15. Changes to Terms

Modification Process:

We may update these Terms to reflect changes in our Service, legal requirements, or business practices.

Significant changes will be communicated via:

• Email notification (if you've provided an email address)
• In-app notification upon next login
• Updated "Last Modified" date at the top of these Terms

Your Options:

• Continued use after changes take effect constitutes acceptance
• If you disagree with changes, you may terminate your account
• Material changes will include a 30-day notice period when reasonably possible
